Aussie MasterCard Home Loan Promotion

TERMS AND CONDITIONS

1. Information on how to participate and gifts form part of these Terms and Conditions. Participation in this promotional offer is deemed acceptance of these Terms and Conditions.

2. The Promoter of the offer is AHL Investments Pty Ltd (A.B.N. 27 105 265 861) of Level 23, 363 George Street, Sydney, NSW 2000 (“Aussie”).

3. The offer is only open to Australian residents aged 18 years or over that: (a) currently hold an Aussie MasterCard; and (b) do not currently have a home loan that has been brokered through the Promoter or one of the Promoter’s franchisees (“Selected Customers”). Employees of the Promoter and the Promoter’s franchisees and their immediate family members are ineligible.

4. Offer commences on 17/01/10 and ends 11:59pm AEDST on 31/03/10 (“Promotional Period”).

5. To participate in the offer, the Selected Customer must, during the Promotional Period, attend an appointment and proceed to the lodgement of a home loan application through Aussie or one of its franchisees. For the sake of clarity, both the appointment and home loan application must be made during the Promotional Period. After lodgement of the home loan application, the Selected Customer will be sent out the gift of a $100. The Selected Customer should allow up to 4 weeks after lodgement of the loan application to receive the gift. Gift will be awarded either in the form of a cheque or deposit in the Selected Customer’s bank account.

The lodgement of an application is subject to the standard terms and conditions of the lender. While the Promoter will take reasonable endeavours to assist the Selected Customer with a home loan application lodgement. The Promoter takes no responsibility should the Selected Customer fail to meet the terms and conditions of the application criteria, in which case they will be ineligible to receive the gift.

6. Multiple home loan applications can be made, however a maximum of one (1) gift per Selected Customer will be awarded. In addition, if the Aussie MasterCard is jointly held, only one (1) of the relevant Selected Customers will receive the gift, as determined by the Promoter in its absolute discretion. The Promoter’s decision is final and no correspondence will be entered into.

7. Gifts are not transferable or exchangeable.

8. If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Selected Customer; or (b) to modify, suspend, terminate or cancel the promotional offer, as appropriate.

9. Except for any liability that cannot be excluded by law, the Promoter and its franchisees (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s of franchisees’ control); (b) any theft, unauthorised access or third party interference; (c) any correspondence or gift that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or the franchisee as applicable) due to any reason beyond the reasonable control of the Promoter or franchisee; (d) any variation in gift value to that stated in these Terms and Conditions; or (e) any tax liability incurred by a Selected Customer.

10. The Promoter may collect personal information in order to conduct the offer and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required. Participation is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Selected Customer. Selected Customers should direct any request to access, update or correct information to the Promoter.
