Aussie Promise to Impress Terms and Conditions

1. Information on how to participate and the promotional offer form part of these Terms and Conditions. Participation in the promotional offer ("Promotion") is deemed acceptance of these Terms and Conditions. Promotional offer not valid in conjunction with any other offer.

2. The Promotion is only open to eligible individuals who are Australian residents aged 18 years or over who are looking to refinance their home loan or take out a new home loan. Employees (and their immediate families) of the Promoter, Aussie Franchisees, Aussie Mortgage Broker their related entities, and agencies associated with this Promotion are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. The Promoter reserves the right, at any time, to verify the validity of claims and participants (including a participant's identity, age and place of residence) and to disqualify any participant who does not participate in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete or illegible claims will be deemed invalid.

4. The Promotion commences on 7.03.2010 and closes when terminated by the Promoter (“Promotional Period”). The Promoter reserves the right to terminate this Promotion at any time with four (4) weeks notice. Termination shall be effective from date of posting notice at www.aussie.com.au, unless otherwise stipulated by the Promoter. Individuals who participate prior to the date of Termination will still have sixty(60) days to claim the gift. Booking an appointment with an Aussie Mortgage Broker is essential for this Promotion, and is subject to availability.

5. To participate in this offer, an individual must, during the Promotional Period, book and attend an appointment to discuss a home loan with an Aussie Mortgage Broker. If the individual is not satisfied with service provided by the Aussie Mortgage Broker, they must visit www.aussie.com.au, follow the prompts and complete and submit the relevant online feedback form (“the feedback form”), including the Aussie Mortgage Broker’s name within sixty(60) days of the date of the appointment. Once the participant has submitted the online feedback form, claiming that they were dissatisfied with the Aussie Mortgage Broker, they will be eligible to receive the gift of $100. For the sake of clarity, the gift will only be paid out if the participant is dissatisfied with the service provided by the Aussie Mortgage Broker. The participant acknowledges and agrees that they can be contacted by a representative of Aussie by telephone to complete the process of finalising their claim. A representative of Aussie may email the participant confirming receipt of the claim. A participant also can make a positive comment, by completing the relevant online form if they were impressed by the Aussie Mortgage Broker. People who complete this particular online form will not be eligible to receive the gift.

6. The Promoter accepts no responsibility if the dissatisfaction is as a result of the direct actions of any third party, including a lender, and not as a result of the actions taken by the Aussie Mortgage Broker.

7. The participant must allow at least 30 days, after submitting their online feedback form, to receive the payment of gift by EFT into their nominated bank account.

8. The participant acknowledges and agrees that the information they provide in the online feedback form can be provided to the Aussie Mortgage Broker which they were not satisfied with.

9. Only one (1) individual per household is permitted to participate in this Promotion. If there is a dispute as to the identity of a participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the participant.

10. The Promoter's decision is final and no correspondence will be entered into.

11. Gifts are not transferable or exchangeable.

12. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the Promotion, and these Terms and Conditions, as appropriate.

13. Certain legislation, including the Trade Practices Act, implies statutory warranties that by law cannot be removed or limited, or only removed or limited to a certain extent. Except for any liability that cannot be excluded by law, the Promoter, Aussie Franchisees, Aussie Mortgage Broker and their related entities (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's, Aussie Franchisees' or Aussie Mortgage Brokers' control); (b) any theft, unauthorised access or third party interference; (c) any claim or gift that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter, Aussie Franchisees or Aussie Mortgage Brokers) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a participant; (f) participation in the Promotion; or (g) receiving a gift.

14. The Promoter, Aussie Franchisees, and Aussie Mortgage Brokers collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, its panel of lenders and as required, to Australian regulatory authorities. Participation is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the participant. Participants should direct any request to access, update or correct information to the Promoter.
